Electronic Communications Policy & E-Sign Consent

1. Purpose and Scope

This Electronic Communications Policy and E-Sign Consent (the “E-Sign Consent”) describes how LeedWallet (“LeedWallet,” “we,” “us,” or “our”) delivers communications electronically and explains your right to consent to receive records and to sign agreements electronically. It applies to all communications, agreements, disclosures, notices, statements, policies, and records (collectively, “Communications”) that we provide or make available to you in connection with our websites, dashboards, APIs, intake funnels, and related services (the “Services”), including without limitation Communications provided to Lead Buyers, Consumers submitting inquiries, and visitors to our websites.

2. Categories of Communications Covered

Your consent applies to all current and future Communications, including:

(a) the Terms of Use, the Privacy Policy, this E-Sign Consent, and any amendments thereto;

(b) account-registration confirmations, credential notices, and authorized-user notifications;

(c) Lead-delivery records, dispositions, and replacement or credit notices;

(d) invoices, receipts, payment confirmations, refunds, credits, and other billing or account statements;

(e) regulatory and compliance disclosures (including TCPA, GLBA, FCRA, and state-law disclosures, to the extent applicable);

(f) service announcements, security alerts, policy-change notifications, and product updates;

(g) marketing and promotional communications (subject to your separate opt-in or opt-out preferences); and

(h) any other notice, disclosure, or record that we are required by law or contract to provide in writing.

3. Hardware and Software Requirements

To access, view, retain, and print Communications electronically, you must have:

(a) a personal computer or mobile device with internet access;

(b) a current, supported version of a major web browser (such as Chrome, Edge, Safari, or Firefox) with JavaScript and cookies enabled and TLS 1.2 or higher;

(c) a valid, monitored email address that you check regularly;

(d) software capable of viewing and saving PDF files (such as Adobe Acrobat Reader or equivalent); and

(e) sufficient electronic storage capacity to save Communications, or a printer to print them.

If our hardware or software requirements materially change in a way that creates a risk that you may not be able to access or retain Communications, we will notify you and give you the opportunity to withdraw your consent without fee.

4. Demonstration of Ability to Access

By submitting your inquiry or registration, clicking “I Agree,” or otherwise accepting these Terms electronically, you affirmatively demonstrate that you can access information in the electronic form in which it will be provided (including HTML web pages and PDF documents). You confirm that the email address and contact information you have provided are accurate, current, and accessible to you, and that you can receive emails and view linked or attached documents.

5. Right to Withdraw Consent

You may withdraw your consent to receive Communications electronically at any time by emailing admin@leedwallet.com with the subject “Withdraw E-Sign Consent” and identifying the records or categories for which you are withdrawing consent.

Consequences of withdrawal:

(a) If you are a Lead Buyer, withdrawal will, at our option, result in suspension or termination of your Account, because the Services are provided exclusively through electronic means and we are not able to provide them on a paper basis.

(b) If you are a Consumer who has submitted an inquiry, withdrawal may delay or prevent our ability to communicate with you about your inquiry and our ability to deliver your inquiry to Lead Buyers, and may result in cancellation of the inquiry.

Withdrawal is effective only after we have had a reasonable opportunity to act on it and only on a going-forward basis. Withdrawal does not affect the legal validity or enforceability of Communications previously provided or transactions previously completed.

6. Updating Your Contact Information

You are responsible for keeping your email address and other contact information current. You may update your information by logging into your account and editing your profile, or by emailing admin@leedwallet.com. We are not liable for any failure of a Communication that is caused by inaccurate, outdated, blocked, or inaccessible contact information that you provided, and any such Communication will be deemed received by you when sent.

7. Paper Copy Requests

You may request a paper copy of any Communication that we are required by law to provide in writing by emailing admin@leedwallet.com within a reasonable time after the original Communication was provided. We do not currently charge a fee for paper copies of legally required disclosures, but we reserve the right to charge a reasonable fee (not to exceed actual production and mailing costs) for paper copies of other records. Requesting a paper copy will not, by itself, withdraw your consent to receive Communications electronically.

8. Retention of Electronic Records

We will retain electronic Communications in a form that is capable of being accurately reproduced for later reference, for the periods required by applicable law and as described in our Privacy Policy. We recommend that you print or save a copy of any Communication that is important to you. We do not guarantee that any specific Communication will remain accessible through the account dashboard for any particular period after delivery.

9. Email and Dashboard Delivery as Effective Notice

You agree that any Communication sent to the email address on file is deemed to be “in writing” and is effective when sent, regardless of whether you actually access or open it (unless we receive a non-deliverable bounce-back). Communications posted within your account dashboard are effective when posted. It is your responsibility to maintain a valid, monitored email address and to check the dashboard and your email for Communications regularly.

10. Legal Effect of Electronic Signatures and Communications

You acknowledge and agree that this E-Sign Consent is provided in connection with one or more transactions affecting interstate commerce, that the federal E-SIGN Act (15 U.S.C. §§ 7001 et seq.) governs this consent, and that you and LeedWallet intend the E-SIGN Act to apply to the fullest extent possible to validate our ability to transact business and execute agreements by electronic means. Your electronic signature — including any click, checkbox acceptance, typed name, button press indicating assent (such as “I Agree,” “Submit,” “Confirm,” “Accept,” or “Continue”), or other electronic indication of assent — has the same legal effect as a handwritten signature and is fully enforceable against you. No certification authority or other third-party verification is necessary to validate your electronic signature. Electronic Communications delivered under this E-Sign Consent satisfy any legal requirement that such Communications be in writing.

11. Federal and Other Applicable Law

This E-Sign Consent and the validity, effect, and enforceability of electronic Communications and electronic signatures hereunder are governed by the laws of the United States and applicable federal law, including the E-SIGN Act, without reference to any state's choice-of-law principles.

12. Changes to This E-Sign Consent

We may update this E-Sign Consent from time to time. The “Last Updated” date above indicates the most recent revision. Material changes will be communicated by posting the revised consent with an updated date and, where feasible, by email notice to the address on file. Your continued use of the Services after the effective date constitutes acceptance of the revised E-Sign Consent.
